These Terms of Use govern access to and use of the website buildfort.pt(the “Website”), operated by Buildfort, a company specialising in construction and renovation project management, with headquarters at Avenida Almirante Reis 25, 1º Dto, 1150-008 Lisbon, Portugal (email: info@buildfort.pt).
By accessing or using this Website, you agree to these Terms of Use. If you do not agree, you should not use the Website.
2. Company and Services
Buildfort provides project management, construction, renovation, energy certification support, real estate mediation, modular homes, solar park investment and light steel frame (LSF) construction services, primarily in the Greater Lisbon region and across Portugal.
Information published on this Website is for general guidance only. It does not constitute a binding offer, professional advice or a contractual commitment unless expressly confirmed in a written agreement signed by Buildfort.
3. Website Use
You agree to use the Website lawfully and not to:
- use the Website in any way that violates applicable law;
- attempt to gain unauthorised access to the Website, servers or related systems;
- transmit harmful, misleading, defamatory or unlawful content through contact forms or other channels;
- reproduce, distribute or commercially exploit Website content without prior written consent from Buildfort.
4. Quotes, Proposals and Contracts
Any quote, estimate or proposal provided by Buildfort is subject to site inspection, technical assessment, applicable permits and final written agreement. Under Portuguese law, construction and renovation contracts are governed by the general rules of the Civil Code (Código Civil), including provisions on contracts for provision of services and works, and by any specific terms agreed between the parties.
A binding contract is only formed when both parties sign a written agreement or otherwise expressly accept the terms of a formal proposal, including scope, price, timeline, payment conditions and responsibilities.
5. Construction and Renovation Services
Construction and renovation works in Portugal may be subject to licensing, prior notification or compliance requirements under applicable legislation, including rules on urban planning, building safety and technical standards. Unless otherwise agreed in writing, responsibility for obtaining permits, licences and regulatory approvals will be defined in the project contract.
Buildfort coordinates qualified professionals and manages projects with a focus on quality, safety and compliance. Clients are responsible for providing accurate information about the property, existing conditions and project requirements.
Hidden defects, structural conditions or unforeseen site issues discovered during works may require additional scope, time or cost, which will be communicated and agreed in accordance with the applicable contract.
6. Warranties and Liability
Buildfort undertakes to deliver services with professional diligence and in accordance with agreed specifications. Legal warranties applicable to construction and renovation services under Portuguese law, including those relating to conformity of works and hidden defects, apply as provided by law and as set out in the relevant contract.
To the extent permitted by law, Buildfort shall not be liable for indirect losses, loss of profit or consequential damages arising from use of the Website or from circumstances outside its reasonable control, including force majeure events.
Nothing in these Terms of Use limits rights that cannot be excluded under mandatory consumer protection rules applicable in Portugal.
7. Consumer Rights
If you are a consumer within the meaning of Portuguese law, you benefit from the rights set out in Decree-Law No. 84/2021, of 18 October, and other applicable consumer legislation, including information rights, complaint mechanisms and access to alternative dispute resolution.
Consumers may submit complaints through the Complaints Book (Livro de Reclamações) or seek online dispute resolution through the Online Dispute Resolution platform, in accordance with Law No. 144/2015 and Regulation (EU) No. 524/2013.
